Please read these Terms and Conditions carefully before using the Consumers Choice website or submitting an enquiry.
1. About Consumers Choice
Consumers Choice operates an introduction service, helping consumers connect with relevant third-party organisations that may be able to assist with their circumstances.
Consumers Choice is not authorised or regulated by the Financial Conduct Authority (FCA) and does not provide financial advice, debt advice, debt counselling or legal advice.
We act as an introducer only.
Any assessment, advice, recommendation or decision concerning the suitability or eligibility of a financial product or debt solution is the responsibility of the relevant appropriately authorised or licensed third-party provider.
2. Our Introduction Service
We may ask you for information about your circumstances so that we can understand the general nature of your enquiry and identify a relevant third-party provider.
Questions asked through our website, WhatsApp, telephone, SMS, email or other communications are used to understand and direct your enquiry.
They do not constitute financial advice, debt advice or a recommendation from Consumers Choice.
Where appropriate, we may pass your personal information to a relevant third-party provider so that they can contact you and consider your circumstances further.
Where we pass your information to a provider, you should be made aware that your information is being passed to that provider and that Consumers Choice may receive a fee for making the introduction.
3. Debt and Financial Enquiries
Where your enquiry concerns debts or financial difficulties, Consumers Choice does not determine which debt solution is appropriate or suitable for you.
Depending upon your circumstances, an appropriately authorised or licensed provider may discuss options including DMPs, IVAs, DROs, bankruptcy, Protected Trust Deeds where applicable, full and final settlements or other available options.
Not every option will be suitable or available to everyone.
Certain debt solutions may affect your credit rating and have other financial or legal consequences. Eligibility criteria apply and fees may apply to some solutions.
The relevant provider is responsible for explaining the advantages, disadvantages, costs, risks and consequences of any option.
4. Third-Party Providers
Where appropriate, Consumers Choice may introduce you to an appropriately authorised or licensed third-party provider.
Following an introduction, that provider is responsible for any:
- Assessment of your circumstances
- Regulated advice or recommendations
- Eligibility decisions
- Applications or proposals
- Products or services
- Fees associated with its services
- Agreements entered into with you
- Ongoing administration or management
Consumers Choice does not control the outcome of an assessment, application or proposal made by an independent provider.
Any subsequent agreement is between you and the relevant provider and will be subject to that provider’s terms and conditions.
Where applicable, you can independently check a firm’s regulatory status using the FCA Financial Services Register.
5. Information You Provide
You must be 18 or over to submit an enquiry through Consumers Choice.
You agree to provide information that is accurate to the best of your knowledge.
Depending on your enquiry, we may ask about:
- Types and approximate amounts of debts
- Employment status
- Housing or living arrangements
- Whether debts are held individually or jointly
- Your current payment situation
- General household financial circumstances
Providing this information does not mean that Consumers Choice has assessed your eligibility or recommended a particular solution.
6. Contact and Communications
Where you submit an enquiry, we may contact you using the details and communication methods you have provided or agreed to use.
This may include telephone, WhatsApp, SMS or email.
Communications may include responses to your enquiry, appointment arrangements, confirmations, reminders and permitted follow-up communications.
Where consent is required for electronic communications, we will seek and respect that consent, and customers must be provided with a clear and easy way to withdraw it. The FCA’s current lead-generator rules expressly address consent for electronic communications and cancellation of that consent.
7. Fees and Our Commercial Relationship
Consumers Choice does not charge consumers for using our introduction service.
Consumers Choice may receive a fee or commission from a third-party provider for making an introduction.
This means Consumers Choice has a financial interest in making an introduction.
A product, service or debt solution subsequently provided by a third party may have its own fees or charges.
Where applicable, these should be explained by the relevant provider before you decide whether to proceed.
8. No Guarantee
Submitting an enquiry or receiving an introduction does not guarantee:
- That a provider will be able to assist you
- Eligibility for a particular debt solution
- Acceptance of an application or proposal
- Creditor acceptance
- Reduced monthly payments
- That any particular amount of debt will be written off
- Any particular financial outcome
Any eligibility assessment or outcome depends upon your individual circumstances and the assessment undertaken by the relevant provider.
9. No Financial, Debt or Legal Advice
Information provided by Consumers Choice through its website, telephone communications, WhatsApp, SMS, email, social media or other communications is provided for general information and introduction purposes.
It must not be treated as financial advice, debt advice, debt counselling or legal advice.
Consumers Choice does not recommend that you enter into a particular debt solution.
10. No Obligation to Proceed
You are under no obligation to accept a recommendation, product or service offered by a third-party provider following an introduction.
You should ensure that you understand the terms, costs, risks, benefits and consequences before entering into any arrangement.
11. Third-Party Websites and Services
Our website and communications may contain links to websites, booking systems and services operated by third parties.
Consumers Choice is not responsible for the content, availability or privacy practices of independent third-party websites.
12. Our Responsibility
Consumers Choice is responsible for providing its introduction service with reasonable care and skill.
As an introducer, however, Consumers Choice is not responsible for independent assessments, advice, recommendations, products or services subsequently provided by third-party organisations.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence or fraud or fraudulent misrepresentation.
Nothing in these Terms affects your statutory rights.
13. Privacy and Data Protection
Personal information is processed in accordance with our Privacy Statement and applicable UK data protection legislation.
Our Privacy Statement explains what information we collect, why we use it, who it may be shared with, how long it may be retained and your data protection rights.
14. Intellectual Property
Unless otherwise stated, content on the Consumers Choice website, including text, branding, graphics and design, is owned by or licensed to the operator of Consumers Choice.
Website content may be used for personal, non-commercial purposes.
It must not be reproduced or commercially exploited without permission except where permitted by law.
15. Website Availability
We endeavour to keep our website and online services available and accurate but cannot guarantee uninterrupted or error-free availability.
We may change, suspend or withdraw website functionality where reasonably necessary.
16. Changes to These Terms
We may update these Terms and Conditions to reflect changes to our services, business arrangements or applicable legal and regulatory requirements.
The current version will be published on our website.
17. Governing Law
These Terms and Conditions are governed by the laws of England and Wales, subject to any mandatory consumer rights that may apply.
